HarvoBot Terms of Use

1. Acceptance of Terms

By accessing or using the HarvoBot website, platform, or any related services (collectively referred to as the "Services"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the Services.

2. Eligibility

You must meet the following criteria to be eligible to register for a HarvoBot Account and use the Services:

Be an individual, corporation, legal person, entity, or other organization with the full power, authority, and capacity to (1) access and use the Services; and (2) enter into and comply with your obligations under these Terms.
 

  • If you are an individual, be at least 18 years old.

  • If you act as an employee or agent of a legal entity and enter into these Terms on their behalf, you must be duly authorized to act on behalf of and bind such legal entity.

  • Not have been previously suspended or removed from using the Services.

  • Not be a Restricted Person as defined by applicable laws and regulations.

  • Not be located in or a resident of:

  1. A jurisdiction where it would be illegal under Applicable Law for you to access or use the Services, or cause us or any third party to contravene any Applicable Law.

  2. A country listed in our List of Prohibited Countries.


3. Use of the Services

You may use the Services only for lawful purposes and in accordance with these Terms of Use.
You agree not to use the Services:
In any way that violates any applicable federal, state, local, or international law or regulation.

To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm HarvoBot or users of the Services or expose them to liability.

To impersonate or attempt to impersonate HarvoBot, a HarvoBot employee, another user, or any other person or entity.
To engage in any fraudulent, deceptive, or misleading activities.

4. NFT Ownership and Usage

HarvoBot NFTs represent digital ownership of a designated plot within a HarvoHub vertical farm.
NFT holders are entitled to a share of the profits generated from the sale of their plot's produce, subject to the terms outlined in the HarvoBot NFT Smart Contract and any applicable Product Terms.
HarvoBot retains ownership and management of the physical HarvoHubs and the underlying agricultural operations.
NFTs are non-refundable and cannot be exchanged for physical assets or cash.
The transfer or sale of NFTs may be subject to restrictions or fees as outlined in the HarvoBot NFT Smart Contract.

5. Intellectual Property

All content and materials on the HarvoBot website and platform, including but not limited to text, graphics, logos, images, and software, are the property of HarvoBot or its licensors and are protected by intellectual property laws.
You may not use, reproduce, or distribute any of these materials without HarvoBot's prior written consent.

6. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. HarvoBot makes no representations or warranties of any kind, express or implied, as to the operation of the Services or the information, content, materials, or products included on the website or platform. HarvoBot does not guarantee the accuracy, completeness, or reliability of any information on the website or platform.
HarvoBot does not warrant that the Services will be uninterrupted or error-free.

7. Limitation of Liability

To the fullest extent permitted by law, HarvoBot shall not be liable for any damages of any kind arising from the use of the Services, including but not limited to direct, indirect, incidental, punitive, and consequential damages. In no event shall HarvoBot's total liability to you for all damages, losses, and causes of action exceed the amount you paid to HarvoBot, if any, in the past six months.

8. Governing Law

These Terms of Use shall be governed and construed in accordance with the laws of the HarvoHub located country, without regard to its conflict of law provisions.

9. Risk Warning

Cryptocurrency investments, including the purchase and ownership of HarvoBot NFTs, are subject to high market risk. You acknowledge and agree that you are solely responsible for any losses incurred in connection with your use of the Services.
The value of HarvoBot NFTs may fluctuate, and there is no guarantee of profit or return on investment.
You should carefully consider your investment objectives, risk tolerance, and financial situation before purchasing any HarvoBot NFTs.
